These Terms of Service (“Terms”) govern your access to and use of the website,
hosting services, client portal, billing system, support services, and related
services provided by Pro Hosting Plans Canada Ltd. (“Pro Hosting Plans,”
“we,” “us,” or “our”).
By using our website, creating an account, ordering services, accessing the
billing system, accessing Plesk, or using any of our services, you agree to these
Terms. If you do not agree with these Terms, you must not use our services.

2. Services
We provide web hosting, email hosting, domain-related services, SSL certificate
support, website tools, support services, and related hosting services.
Additional services such as website design, redesigns, managed website plans,
marketing services, or custom technical work may be offered separately and may
be subject to separate terms, quotes, or agreements.
Our services may rely on third-party infrastructure, software, datacenters,
registrars, payment processors, control panels, email systems, security tools,
and other providers. We are not responsible for third-party outages, policy
changes, price changes, or service interruptions outside our reasonable control.
3. Eligibility and Account Responsibility
You must be at least 18 years old or the age of majority in your province,
territory, or jurisdiction to use our services.
You are responsible for maintaining accurate account, billing, and contact
information. You are also responsible for all activity that occurs under your
account, including activity by your employees, contractors, users, or anyone to
whom you provide access.
You must keep your login credentials secure and must notify us immediately if
you believe your account, billing access, Plesk access, email account, or hosting
service has been compromised.
4. Mandatory Two-Factor Authentication
For security reasons, two-factor authentication (2FA) is mandatory for
access to the billing system, client portal, Plesk control panel, and any other
administrative systems where 2FA is made available or required.
You agree to enable and maintain 2FA on all required accounts. If 2FA is not
enabled, is removed, is bypassed, or cannot be verified, we may restrict, suspend,
or block access to the billing system, Plesk, hosting control panels, or other
administrative systems until 2FA is properly enabled.
We may also require password resets, identity verification, or additional
security checks before restoring access. These measures are intended to protect
your account, your website, our systems, and other customers.
5. Billing, Payments, and Renewals
Services are billed in advance according to the billing cycle selected at the
time of purchase. Billing cycles may include monthly, annual, or other prepaid
terms.
All prices are listed in Canadian dollars unless stated otherwise. Applicable
taxes will be added where required. We strive to present pricing clearly and
avoid hidden mandatory fees. Government-imposed charges, such as applicable
taxes, may be added at checkout.
You are responsible for paying all fees associated with your services by the due
date shown on your invoice. Failure to pay may result in suspension or
termination of services.
Annual Prepaid Hosting
Annual prepaid hosting plans may receive a discounted rate. The price for an
annual prepaid hosting plan is locked in for the prepaid term. Renewal pricing
may change if our costs or service pricing changes, but we do not use inflated
renewal pricing or surprise rate jumps.
Automatic Renewal
If automatic renewal or recurring billing is enabled, you authorize us and our
payment processor to charge your selected payment method for recurring service
fees, applicable taxes, and renewal charges until the service is cancelled or
terminated.
Price Changes
We may change service pricing from time to time. Price changes will not affect
an already-paid prepaid term. Any renewal price changes will apply at the next
renewal period and will be communicated through invoice notices, account notices,
email, or website updates where appropriate.
6. Cancellations and Refunds
You may request cancellation of services through the billing system or by
contacting us. Cancellation will normally take effect at the end of the current
paid billing period unless otherwise stated.
Hosting services are billed in advance. Monthly hosting fees are generally
non-refundable once the billing period has started. Annual prepaid hosting is
generally non-refundable once activated, except where required by law or agreed
to by us in writing.
Domain registrations, domain renewals, SSL certificates, third-party licences,
setup fees, custom work, website design work, migration work, and other
third-party or labour-based services may be non-refundable once ordered,
activated, registered, renewed, or performed.
If you cancel a service, you are responsible for downloading or backing up any
data you need before the service is terminated.
7. Account Suspension and Termination
We may suspend or terminate services if:
- Invoices are overdue or unpaid;
- You violate these Terms or our Acceptable Use Policy;
- Your account creates a security risk;
- Your website, email, or account is used for spam, phishing, malware, abuse, or illegal activity;
- You fail to enable required 2FA;
- Your usage negatively affects our infrastructure, other customers, or service stability;
- We are required to do so by law, regulation, court order, provider policy, or upstream provider requirement.
Suspension does not cancel your responsibility for unpaid fees. We may charge a
reconnection or administrative fee where reasonable and applicable.
8. Acceptable Use
You agree not to use our services for unlawful, harmful, abusive, or disruptive
purposes. Prohibited activities include, but are not limited to:
- Sending spam or unsolicited bulk email;
- Hosting phishing pages, malware, viruses, botnets, or harmful code;
- Distributing illegal, infringing, or abusive content;
- Attempting unauthorized access to systems, networks, or accounts;
- Running denial-of-service attacks or abusive scanning tools;
- Hosting content that violates intellectual property rights;
- Using services in a way that harms service stability or other customers;
- Using email services in violation of anti-spam laws or provider policies;
- Misrepresenting your identity or business;
- Using services for fraudulent, deceptive, or unlawful activity.
We may remove content, disable services, suspend accounts, or take other action
if we believe there is abuse, a security risk, or a violation of these Terms.
9. Email Services and Anti-Spam Rules
If email services are included with your hosting plan, you are responsible for
using them lawfully and responsibly. You must not use our email services to send
spam, phishing messages, deceptive emails, malware, or unsolicited commercial
electronic messages.
If you send commercial electronic messages, you are responsible for complying
with applicable laws, including Canada’s Anti-Spam Legislation (CASL), where
applicable. This may include obtaining proper consent, identifying yourself, and
providing an unsubscribe mechanism.
We may suspend or restrict email services if your account causes blacklisting,
spam complaints, abuse reports, excessive bounce rates, or deliverability issues.
10. Resource Usage
Hosting plans include allocated resources such as storage, bandwidth, CPU,
memory, email limits, databases, and other service limits. You agree to use
services reasonably and in a way that does not negatively affect other customers
or service stability.
We may contact you, limit usage, recommend an upgrade, suspend services, or take
corrective action if your account uses excessive resources or causes service
degradation.
11. Backups and Customer Data
We may provide automated backups as part of certain hosting plans. Backups are
provided as a convenience and are not a substitute for your own independent
backup practices.
You are responsible for maintaining your own copies of website files, databases,
emails, and other important data. We do not guarantee that any backup will be
available, complete, current, or free from corruption.
We are not liable for loss of data, lost revenue, business interruption, or other
damages resulting from data loss, backup failure, customer error, third-party
software issues, malware, or service interruptions.
12. WordPress, Themes, Plugins, and Website Tools
Some hosting plans may include tools intended to help you build or manage your
website, including WordPress-compatible hosting, Divi-related tools, templates,
or design resources.
Unless expressly stated in writing, included website tools do not mean that
custom website design, redesigns, content updates, plugin configuration, custom
development, troubleshooting of third-party plugins, or ongoing website
maintenance are included for free.
Certain hosting plans may include access to Divi Theme Builder or related design
tools while the hosting plan remains active and eligible. These tools are
provided as part of the eligible hosting package and may not be transferred,
resold, sublicensed, or used outside the eligible hosting environment unless
expressly permitted.
Professional website design, redesigns, managed website plans, custom
development, marketing services, and content work may be available as optional
paid services under separate pricing, terms, or agreements.
13. Domains and Third-Party Services
Domain registrations, renewals, transfers, DNS services, SSL certificates, email
filtering, licences, control panels, and other third-party services may be
subject to additional terms imposed by registrars, certificate authorities,
software vendors, datacenters, infrastructure providers, or other third parties.
You are responsible for ensuring domain contact details are accurate and for
renewing domain names before expiry. We are not responsible for domain loss,
expiry, redemption fees, transfer delays, registry policies, or third-party
provider actions outside our reasonable control.
14. Datacenter and Infrastructure Claims
Our hosting services may rely on third-party datacenter and infrastructure
providers. References to certifications, audits, compliance standards, or
security frameworks, including ISO 27001, PCI-DSS, SOC-related audits, or
independent audit standards, refer to the applicable infrastructure provider,
datacenter, or service environment, and do not necessarily mean that Pro Hosting
Plans Canada Ltd. is separately certified under those standards.
We make reasonable efforts to use reputable infrastructure providers, but we do
not guarantee uninterrupted service, absolute security, or compliance with every
industry-specific requirement that may apply to your business.
15. Support
Support is provided through the channels we make available, such as support
tickets, email, client portal, or other contact methods. Support availability,
response times, and scope may vary depending on the service, plan, issue, and
support workload.
Standard hosting support may include help with hosting access, billing,
service availability, DNS guidance, email hosting guidance, SSL support, and
general hosting-related questions.
Unless included in your plan or agreed to in writing, support does not include
custom coding, website redesigns, advanced troubleshooting of third-party
plugins or themes, malware cleanup, SEO campaigns, content writing, graphic
design, or extensive website changes.
16. Privacy
We collect and use personal information as needed to provide services, process
orders, manage billing, provide support, communicate with customers, secure our
systems, and comply with legal obligations.
Our handling of personal information is described in our Privacy Policy. By using
our services, you agree to our collection, use, and disclosure of personal
information as described in the Privacy Policy.
Because we provide commercial services in Canada, privacy laws such as PIPEDA
may apply to how personal information is collected, used, and disclosed.
17. Customer Content
You retain ownership of the content you upload to your hosting account, including
website files, databases, images, email, and other customer content.
You represent that you have the necessary rights to use, publish, store, and
transmit any content you place on our services. You are solely responsible for
your website content, email content, files, databases, and account activity.
We may remove or disable access to content if we believe it violates these Terms,
our policies, applicable law, third-party rights, or upstream provider
requirements.
18. Security
You are responsible for maintaining secure passwords, enabling required 2FA,
keeping website software updated, using secure plugins and themes, and managing
access for your users, contractors, and administrators.
We may take security action, including password resets, 2FA enforcement,
temporary access restrictions, service suspension, malware isolation, or account
review, where we reasonably believe there is a security risk.
19. Service Availability
We make reasonable efforts to provide reliable services. However, no hosting
service can be guaranteed to be uninterrupted, error-free, or completely secure.
Services may be unavailable due to maintenance, emergencies, network issues,
third-party outages, datacenter events, software issues, abuse mitigation,
security incidents, or circumstances outside our reasonable control.
We are not responsible for losses resulting from downtime, interruptions,
maintenance, third-party failures, or events outside our reasonable control.
20. Limitation of Liability
To the maximum extent permitted by law, Pro Hosting Plans Canada Ltd. will not be
liable for indirect, incidental, special, consequential, exemplary, or punitive
damages, including loss of profits, loss of revenue, loss of business, loss of
data, reputational harm, or business interruption.
To the maximum extent permitted by law, our total liability for any claim related
to the services will be limited to the amount you paid to us for the affected
service during the six months immediately before the event giving rise to the
claim.
Some jurisdictions do not allow certain limitations of liability. In those cases,
our liability will be limited to the maximum extent permitted by applicable law.
21. Indemnification
You agree to indemnify and hold harmless Pro Hosting Plans Canada Ltd., its
directors, officers, employees, contractors, and service providers from claims,
losses, damages, liabilities, costs, and expenses arising from:
- Your use of the services;
- Your violation of these Terms;
- Your website, email, files, data, or customer content;
- Your violation of applicable law;
- Your violation of third-party rights;
- Abuse, spam, malware, phishing, or security incidents caused by your account.
22. Changes to Services or Terms
We may update these Terms from time to time. The updated version will be posted
on our website with a revised “Last updated” date.
Your continued use of the services after updated Terms are posted means you
accept the updated Terms. If you do not agree with the updated Terms, you must
stop using the services and cancel any affected services.
23. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the
applicable federal laws of Canada.
Any disputes will be handled in the courts of British Columbia, Canada, unless
another forum is required by applicable law.
